General Terms and Conditions

  1. Scope

These General Terms and Conditions apply to all orders placed by customers through the online shop VICIOUS™ at shopvicious.net.

  1. Formation of Contract

The presentation of products in the online shop does not constitute a legally binding offer to conclude a purchase contract.

By submitting an order, the customer makes a binding offer to purchase the goods contained in the shopping cart.

The contract is concluded once we expressly confirm the order or the goods are shipped.

The customer receives an electronic confirmation to the email address provided after the order is received.

  1. Prices and Payment Terms

The prices stated in the online shop at the time of the order apply.

The payment methods available during the respective order process will be shown to the customer.

Depending on availability, the following payment methods may be offered, among others:

Depending on the country, device, order, and payment service provider, certain payment methods may not be available.

  1. Delivery and Shipping

We generally offer worldwide shipping.

Standard shipping is free worldwide, unless otherwise stated for the relevant product.

Processing time is typically 1–5 business days after receipt of order and successful payment confirmation.

Standard shipping time thereafter is typically 7–14 business days.

The delivery times stated are estimates. For international shipments, delays may occur in particular due to customs clearance, official inspections, transport delays, holidays, high shipping volume, or circumstances beyond our control.

Depending on the destination country, customs duties, import taxes, fees, or other charges may apply. Where these are legally payable by the recipient, they are not covered by us.

  1. Delivery Restrictions

We generally ship worldwide, provided there are no legal, logistical, or other restrictions for the respective destination country.

Should delivery restrictions exist for certain countries or regions, these will be shown to the customer during the ordering process.

  1. Right of Withdrawal

Consumers are generally entitled to a statutory right of withdrawal of fourteen days.

  1. Statutory Warranty

The statutory provisions on liability for defects apply.

The customer's statutory rights in respect of defective goods are not restricted by these Terms and Conditions.

  1. Retention of Title

The goods remain our property until full payment of the purchase price has been made.

  1. Liability

We are liable in accordance with statutory provisions for damages arising from intentional or grossly negligent breach of duty.

For damages resulting from injury to life, body, or health, as well as for claims under mandatory statutory provisions, the statutory provisions apply.

In all other respects, the statutory liability provisions apply.

  1. Data Protection

Information on the processing of personal data can be found in our Privacy Policy.

  1. Consumer Dispute Resolution

We are generally neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

  1. Final Provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory statutory consumer protection provisions provide otherwise.

For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the state in which the consumer has their habitual residence.
